Terms and Conditions of Use
This page sets out the terms and conditions on which we give you access through www.thegodquestion.tv/introduce (the Website) to the web-streamed content, including but not limited to, any of the six episodes of Introducing the God Question series (the Web-streamed Content) and any downloadable material including the associated online Study Guide and Teacher's Guide in pdf (the Online PDFs). Please read these terms and conditions carefully and make sure that you understand them if you intend to use the Website or intend to purchase any of our Introducing the God Question resources including but not limited to the DVD boxsets, Study Guide, Teacher's Guide, Web-streamed Content and the Online PDFs (the Products).
These terms and conditions apply to the entire contents of the Website and to any correspondence by e-mail between us (or our agents) and you. This notice is issued by Kharis Productions Limited. Kharis Productions Limited is a company registered in Scotland, Company Number SC231610 (the Company).- Introduction
- You may access most areas of the Website without registering your details with us. Certain areas of the Website are only open to you if you register.
- By accessing any part of the Website, you shall be deemed to have accepted this legal notice in full. If you do not accept these terms and conditions in full, you should leave the Website immediately.
- The Company may revise these terms and conditions at any time by updating this posting. You should check the Website from time to time to review the current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages at the Website.
- Licence
- On purchase of any of our Web-streamed Content or Online PDFs we grant you a non-exclusive, non-transferable licence to access and view or download the online-only products as applicable. Except for this said limited licence, no right, title or interest shall be transferred to you.
- You are permitted to access and stream the Web-streamed Content and download and view the Online PDFs from the Website on the following basis:
- (a) all Products are for personal and non-commercial use;
- (b) all Web-streamed Content is viewed by an audience numbering 34 people or fewer, otherwise a licence is required (click here for licencing information)
- (c) the number of devices on which you may access the Products is limited to a maximum of three at any one time;
- (d) Web-streamed Content viewings are unlimited with an understanding of fair use being applied. Use of the Web-streamed Content is monitored within the terms of our Privacy Policy and, if we reasonably suspect unfair use and after attempts have been made to contact you, we reserve the right to impose additional charges or remove your user account. Unfair use is deemed to characterise situations in which unusually high levels of access are apparent, lending weight to the conclusion that the user is spreading use of the Web-streamed Content beyond that which is reasonably expected of a single user or where more than three devices are used to access the Web-streamed Content.
- You are permitted to print and download extracts from the Website for personal, non-commercial use on the following basis:
- (a) no documents or related graphics on the Website are modified in any way;
- (b) no graphics on the Website are used separately from the corresponding text; and
- (c) the Company's copyright notice and/or trade mark notice appear on all copies
- (d) no use of any extracts from the Website may be taken out of context or used to tarnish the image of Kharis Productions Ltd.
- (e) no extracts from the Website may be used to state or imply the endorsement by Kharis Productions Limited or used in any other manner than might be misleading.
- You are not permitted to:
- (a) archive or download the Web-streamed Content and Online PDFs except as explicitly authorised in clause 2 above
- (b) republish or reproduce any of the Products (including republication on another website) without the knowledge and permission of the Company;
- (c) sell, rent, licence or sublicense any material from any of the Products;
- (d) reproduce, duplicate, distribute, copy or otherwise exploit the Products for any purpose without the knowledge and permission of the Company.
- (e) edit, create derivative works from, or otherwise modify any of the Products; or
- (f) distribute (except as explicitly authorised by the Company) any content and information from the Products, with the exception of content specifically and expressly made available for redistribution.
- (g) Post any defamatory content on the Website.
- Unless otherwise stated, the copyright and other intellectual property rights in all material on the Website (including, without limitation, video, photographs and graphical images) are owned by the Company or its licensors. For the purposes of these terms and conditions, any use of extracts from the Website other than in accordance with clause 2 for any purpose is prohibited. If you breach any of these terms, your permission to use the Website automatically terminates.
- Subject to clause 2.1, no part of the Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without the Company's prior written permission.
- Any rights not expressly granted in these terms are reserved.
- Service access
- While the Company endeavours to ensure that the Website is normally available 24 hours a day, the Company shall not be liable if for any reason the Website is unavailable at any time or for any period.
- Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the Company's control.
- Links to and from other websites
- Links to third party websites on the Website are provided solely for your convenience. If you use these links, you leave the Website. The Company has not reviewed all of these third party websites and does not control and is not responsible for these websites or their content or availability. The Company therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Website, you do so entirely at your own risk.
- Price and payment
- Prices and delivery charges will be as quoted on our Website from time to time, except in cases of obvious error.
- Product prices include VAT. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.
- Payment for all Products must be made by credit or debit card.
- Disclaimer
- While the Company endeavours to ensure that the information on the Website is correct, the Company does not warrant the accuracy and completeness of the material on the Website. The Company may make changes to the material on the Website, or to the Products and prices described in it, at any time without notice. The material on the Website may be out of date and, although the Company will take reasonable steps to update such material, the Company makes no commitment to do so.
- Privacy Policy
- You require to register with us to be able to purchase any of our Products. When you register, you will be asked to provide some personal information, including your name and email address. In accordance with the General Data Protection Regulation we will store your personal information, but will not share it with any third parties except as necessary to provide the services offered or where required by law. - Other than personally identifiable information, covered under clause 7.1, any material you transmit or post to the Website shall be considered non-confidential and non-proprietary. The Company shall have no obligations with respect to such material.

- The Company, any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and any of the Company's directors, employees, or agents, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in delict [including without limitation negligence], contract or otherwise) in connection with the any of our Products or the Website in any way or in connection with the use, inability to use or the results of use of the Products or Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Website or your downloading of any Products from the Website or any websites linked to the Website.
- Nothing in these terms and conditions shall exclude or limit the Company's liability for:
- (a) fraud; or
- (b) misrepresentation as to a fundamental matter; or
- (c) any liability which cannot be excluded or limited under applicable law.
- Governing law and jurisdiction
- These terms and conditions shall be governed by and construed in accordance with Scots law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Scottish courts.
